On 20 December 2007 in Berne, the Polish Minister of Regional Development, Mrs. Elżbieta Bieńkowska has signed an agreement concerning the implementation of the Swiss-Polish Cooperation Programme. Switzerland has made available CHF 1 billion for the countries that joined the European Union on 1 May 2004. The contribution to Poland amounts to CHF 489,02 million.

Backgroud

In October 2007 the Ministry of Regional Development has finished the negotiations with Swiss partner on  the Framework agreement between the Government of the Republic of Poland and the Swiss Federal Council concerning the implementation of the Swiss-Polish Cooperation Programme to reduce economic and social disparities within the enlarged European Union. The document was approved by the Polish Council of Ministers on 7 November 2007 and by Swiss Federal Council on 21 November 2007.

Amendments to Annexes 1, 2 and 3 of the Framework Agreement

On 6th July 2010, Swiss and Polish side amended Annexes 1, 2 and 3 of the Framework Agreement. The most important amendments concerned Annex 1 and aimed to re-allocate between the focus areas not yet allocated funds indicated in the Framework Agreement. Moreover, new types of activities have been added within the focus area “Measures to secure borders”. New types of activities allowed to support projects aimed to improve the management of immigration and asylum issues and also awareness campaigns and activities aimed at strengthening the internal security.

Managament and implementation system

The document was adopted by the Minister for Regional Development, Mrs. Elzbieta Bieńkowska 30 June 2008, as amended on 19 November 2008, 29 January 2009, 1 April 2011.

The document defines the objectives and principles of operation of the program, institutional structure, the system of application and evaluation of proposals and implementation issues such as signing agreements, transfer of funds, monitoring and reporting, and control and auditing.

Guidelines to orders under the Swiss-Polish Cooperation Programme, to which the Act of 29 January 2004 – Public Procurement Law is not applicable.

Guidelines shall be aplicalbe to:

  • all contracts awarded by the Intermediate Bodies (IB), Executing Agencies (EA)  and project partners (excluding entities from donors state) who are not obliged to comply with the Act of 29 January 2004 – Public Procurement Law (PPL Act);
  • contracts of a value not exceeding the equivalent of amount expressed in PLN referred to in Article 4 point 8 of the PPL Act, awarded by IB/EA/project partners obliged to comply with the said Act,
